1.2.3 is pleased to welcome you and provide you with the www.1-2-3.com shopping site (hereinafter referred to as the Site).
These general conditions of sale exclusively govern the sales of products offered by 1.2.3 on the Site. They are routinely made available on this Site to the Customer when an order is placed. Accordingly, merely placing an order implies full and unreserved acceptance by the Customer of these Terms and Conditions of Sale to the exclusion of all other conditions set out in brochures or catalogues issued by the seller and in particular those in effect in 1.2.3 stores.
Unless expressly agreed, any contrary condition set down by the Customer, shall be unenforceable against 1.2.3 no matter when it may have been brought to its attention. The fact that 1.2.3 does not invoke any of these clauses at a particular time cannot be interpreted as a waiver to invoke them later.
1.2.3 strives to do its utmost to provide accurate and up to date information on this Site. It reserves the right to modify the content at any time and without prior notice.
This Site is for strictly personal use only. It is clearly stated that the purchase of Products on the Site is reserved for non-commercial individuals in their capacity as consumers who are over the age of 18 and have full legal capacity.
In the absence of any condition, it shall be deemed to be governed by French laws and customs in force concerning distance selling.

Article 2: Subject

These conditions are intended, firstly, to inform any potential buyer of the terms and conditions under which 1.2.3 as seller makes the sale and delivery of 1.2.3 items ordered at the site www.1-2-3.com; and secondly to define the rights and obligations of the Parties concerning the sale of goods by 1.2.3 to the Client . These apply without limitation or qualification to all sales of products offered by 1.2.3 on the Site.

3.2 Product characteristics

The products offered for sale are described and presented with the greatest possible accuracy. The information provided on the product data sheet includes the essential characteristics of products (colour, description, composition, maintenance, dimensions), their price inclusive of all taxes, under the conditions specified under Article 4 below.

3.3 Product availability

Products are offered for sale subject to available stock. Only products listed on the website on the day that the Client visits it are available for sale. Thus, when ordering, the customer is informed of the availability of the selected product. Web Customer Service of 1.2.3 will be at the disposal of each Client for all questions relating to the availability of goods for sale on this Site.

3.4 Purchase limit

The site does not allow products to be purchased for resale. In this respect, the Client's attention is particularly drawn to the fact that orders may not exceed fifteen (15) articles per order, nor be of an unusual nature or exceed 2,000 Euros. Customers wishing to make a purchase totalling in excess of that amount, provided it is not for the purpose of resale, should contact the 1.2.3 Web Customer Department to inquire about the possibilities and conditions of purchase in effect on this site.

Article 4: Price

Prices are given in Euros and are inclusive of all taxes excluding shipping and delivery to the countries concerned. The lump sum payment for the costs of preparation and delivery is communicated to the Customer in the order summary before the order is confirmed. Prices include the VAT applicable on the date of the order. If there is a change in the VAT rate, this will be reflected in the price of the items.
1.2.3 reserves the right to amend prices and product descriptions at any time in the event of increases in charges, including VAT rates, and in the event of typographical errors or an obvious input error. However, products will be billed on the basis on rates applicable at the time the order is recorded unless there is an obvious error.
The Order constitutes acceptance of the prices and descriptions of products available for sale. Any dispute on this point must be with a view to a possible refund as detailed below in section 8.

Article 5: The Order

5.1 Personal and confidential data/Customer number

Every Customer must fill in the fields that are given to create the Customer Profile and obtain login information which is for his use only.1.2.3 must be promptly informed of any lost or forgotten information by contacting the Web Customer Department. To place an order, the Customer must complete a registration form and enter the necessary identification information:
  • Valid email and password of your choice (personal and confidential) to identify the Customer on the Site,
  • Personal data marked with an asterisk that is required and necessary for processing invoices and delivering of orders.
It is important that the customer fill in the form as accurately as possible in order to avoid any errors or problems in delivering the items ordered. The data recorded on this Site is intended solely for 1.2.3 or its partners as expressly accepted by the Customer under the conditions specified below.
In accordance with the Data Protection Act No. 78-17 of 6 January 1978, the Customer has the right to access and correct relevant data at any time. To do so, the Customer need only send their details:

A Customer may accept or reject the use of their data by 1.2.3 by expressly stating such in the registration form or by sending a request using one of the two methods noted above.
The site is also designed to be particularly attentive to the needs of its Customers. For this reason 1.2.3 uses of cookies. The purpose of the cookie is to indicate that the Customer has visited the Site. Cookies are only used by the Site in order to improve the personalised service aimed at the Customer.
After each visit to the Site, the Customer must remember to log out to ensure their details remain confidential.
1.2.3 draws attention to the fact that dependent minors are incapable of entering into a contract. As such, any orders for minors must be placed by their legal guardians. If accidental collection of personal data relating to minors occurs, legal guardians are entitled to object to its storage and/or transmission to third parties.

5.2 Placing an order

Any Customer wishing to place an Order should select the Product of their choice by clicking on “Add to your bag” and then cliking on “Go to checkout”.
After this step, a summary page corresponding to the purchase order appears, allowing the customer to make any changes by clicking “Continue my shopping”.
By validating the order, the Client expressly agree the Terms and Conditions he can read anytime on the website.

5.3 Order confirmation and payment

In making a purchase, the customer assures 1.2.3 that they have the necessary permissions to use the payment method chosen when placing the Order. In confirming the Shopping Cart by clicking on the icon “Complete my order” on the purchase order summary and accepting of the General Conditions of Sale, the Customer agrees to proceed to the order confirmation and payment stage. The price payable by the Customer is the amount indicated on the order summary of which the Customer has been informed before confirming the order. This confirmation confirms acceptance of all transactions made on the Site.
All orders placed on the Site shall be processed exclusively online using one of the following credit cards: Visa, MasterCard, Amex.
The Order will not be processed until the credit card number, expiry date and CVC number (3 digit number on the back of your credit card) have been entered for payment. This payment is subject to final approval by the issuing bank. The card is debited when the order is dispatched. If an item is out of stock, any amounts for the items cancelled will be deducted from the total amount debited or will be credited to the Customer’s account within 3 working days after the debit amount for any items cancelled.
In any event, provision of credit card details and the final confirmation of the Order online, constitute proof of your full Order in accordance with the provisions of the Act of 13 March 2000 and resulting in any amounts listed for items on the order form becoming payable.

5.4 Payment security

1.2.3 uses the Adyen secure payment service, which incorporates standard SSL payment security. Confidential data (card number, expiry date) are sent encrypted directly to the Adyen server and at no time sent over our server. The Adyen server itself is directly connected to the servers of banks in each country.

5.5 Receipt of order

The final order confirmation is given after confirmation of payment.
An email confirmation of the order and payment will be sent to the Customer confirming their registration along with a summary of all the information already provided and the Terms.

5.7 Order tracking

The breakdown and tracking of the delivery of each order is available at any time on the Site after the Customer has logged on.

Article 6: Shipping

Except in cases of force majeure or unforeseeable and insurmountable events, delivery times will be those listed below and shall run from the order confirmation date. They will be communicated to the Customer before checkout and payment. The Customer must choose the country of delivery and delivery method when one is offered.
1.2.3. takes every precaution to ensure that parcels arrive in perfect condition. However, the Customer must check the condition of the packaging and the appropriateness of the product delivered and if necessary state any reservations on the carrier’s delivery slip.

6.1 Delivery methods:

Parcels are delivered by the postal service to the Customer’s home or any other address selected (to be specified on the delivery form), provided that it is in one of the countries listed in Article 3.1,
1.2.3 processes packages from Monday to Friday. In general, Orders are processed within 2-3 days. Additional delays are those caused by the postal service. Generally, these do not exceed 10 days.
Please note that, at certain times (Sales, Fashion Days, etc.), processing times may be longer due to the large volume of packages to be processed.
If the Client is not at home, a notice will be left in his mailbox.

6.3 Delivery times

All deliveries are made within 13 days from the date of order. If it takes more than 13 days from the shipping date (except in cases of force majeure), the Customer may:
  • Notify the delay by email to the following address: webcustomerservice@1-2-3.com. In this case, 1.2.3 will contact the postal services to investigate. This should not take longer than 30 days. At the end of the investigation, if the package has not been located, the Customer will be refunded the order amount.
  • May cancel the order and request a refund by sending a registered letter to 1.2.3. requesting a return receipt

All refunds will be made within 14 (fourteen) days of the cancellation. The Customer’s bank account will be directly credited with the amount of the returned items using the secure payment partner Adyen.

6.4 Shipping:

Shipping costs depend on the delivery zone. Orders over €120 do not incur shipping fees.

For packages shipped outside the European Union (EU), customs duties or other local taxes or import duties or state taxes may be payable.
The payment of these duties and taxes are the sole responsibility of the Client, regardless of the amount.

Article 7: Cooling-off period

7.1 Cancelling an order

The Customer has the right to cancel an order for a period of 14 (fourteen) days from the receipt of the order. They may exercise this right without having to justify the decision and need not pay any costs other than those incurred in returning the order. To exercise this right, the customer is required to return the cancellation form attached to the e-mail order confirmation, or available on the Site, or any other statement, clearly written, expressing their wish to cancel. Products must not have been worn or washed and must be returned with their original packaging and original label, accompanied by the invoice or packing slip (the invoice is available on the website, under “My Account”, the delivery order is included in your package). Caution: items returned incomplete, damaged or soiled by the customer are not accepted.

7.2 Returns:

Within 14 (fourteen) days following the communication of the decision to cancel according to the conditions set out under Article 7.1 above, the Customer may return any items ordered from 1.2.3., at their own expense, accompanied by (i) the cancellation form or any other clearly worded statement, (ii) the invoice or delivery order to the following address:

1.2.3. will refund the Customer any amounts paid (product price and any delivery costs) upon receipt of the products ordered or when the Customer has provided proof of shipment of the products, whichever is first.
The Customer’s bank account will be directly credited with the amount of the returned items using the secure payment partner Adyen.

Article 8: Echanges et Remboursement

Without prejudice to the provisions relating to the exercise of the right to cancel, and for commercial purposes, 1.2.3 offers the Customer the option of changing his mind within 30 days of the receipt of the order, including during sales or promotion periods, by presenting of the necessary invoice or the delivery order for any unworn item from the current season. The product in question must have its original label. The invoice is available on the website under “My Account”. The delivery order is sent with the items ordered.
In this case, the Customer shall return any items by post at their own expense to the following address:

No shipping costs will be charged to the Customer if the return is due to an error on the part of 1.2.3.
Items returned incomplete, damaged or soiled by the customer are not included
In the event of a refund request, this should be carried out within 5 working days of receipt of the parcel. The Customer’s bank account will be directly credited with the amount of the returned items using the secure payment partner Adyen.In that case, a refund confirmation email will be sent.
In the event of an abnormal or excessive refund request, 1.2.3 may reserve the right not to process any subsequent Orders.

Article 10: Warranty

The products offered conform to French legislation in force. All products are covered by statutory warranty as well the warranty against latent defects.

Article 11: Liability

Despite the care given to the site, texts and photographs illustrating the products may sometimes contain errors. Should the customer receive an item that differs from the one viewed on the Site, they may request a refund in accordance with Articles 7 and 8 above.
1.2.3 company shall not be held liable for breach of contract in the event of the following:

  • product is out of stock or unavailable,
  • total or partial disruption of postal services or means of transport and/or communications.
  • floods, fires, any event of force majeure and other unforeseeable events beyond the control of 1.2.3.

1.2.3 shall not be liable for any damages resulting from such events, operating loss, loss of profit, loss of opportunity, damages or expenses.

Hypertext links may lead to other websites than this Site. 1.2.3 disclaims any liability in the event that the content of these web sites violates legal and regulatory provisions in force.

Finally, 1.2.3 is not liable for:
  • any interruption of the Site, the occurrence of bugs or damage resulting from fraudulent intrusion by a third party leading to a change in the information available on the Site,
  • for non-substantive errors relating to products,
  • for inability to contact customer services and/or to access the Site.

Article 12: Intellectual property rights

Use of the Site is strictly reserved for personal use. In accordance with laws governing literary and artistic property rights or other similar rights, this site and all elements contained herein are subject to copyright.
Unless otherwise stated, trademarks, industrial designs, logos, photographs, images, graphics, etc. located on this Site, as well as their compilation, are the sole property of 1.2.3. 1.2.3 draws attention to the fact that any partial or full reproduction, use or modification, of any element of the site is strictly prohibited without the prior, special and express permission of 1 .2.3. Accordingly, 1.2.3 may bring proceedings, against anyone who, directly or indirectly, violates these rights, particularly in the case of infringement.

Article 13: Claims

For questions about an existing order, Web Customer Services Department will be available to the Customer should:
  • use the “Contact Us” function to ask a question directly, or
  • contact Web Customer Service by email at: webcustomerservice@1-2-3.com.

In the event of a complaint, the Customer must give the Order number and the exact reason for the complaint. When the problem is resolved a refund will be made directly into the Customer's bank account through the secure payment partner Paybox. Investigations relating to the postal service to find out the routing of a package shall not exceed 30 days. Finally, more than two months after the opening of a complaint case, requests for refund cannot be considered as 1.2.3.’s bank is only able to perform charge-back operations within a 60 day period.

Article 14: Validity

These conditions apply for the duration of the period the products and services are offered for sale online by 1.2.3.

Article 15: Proof

The records stored in the databases of 1.2.3 and its partners under reasonable security conditions will be considered as proof of communications, orders and payments that occurred between 1.2.3 and the Client.

Article 16: Applicable law - jurisdiction

This contract is subject to French law. The language of this contract is the French language. In the event of dispute, the Parties agree to seek an amicable solution prior to any legal action. The French courts shall have jurisdiction.

Article 17: Changes

Given the possibility of changes on the Site, 1.2.3 reserves the right to make changes to these General Terms and Conditions of Sale at any time. The new Terms and Conditions of Sale will, where appropriate, be communicated to the Client by online changes and will apply only to sales made after the change (those accepted by the Customer at the time the order is placed). 1.2.3 asks its customers to regularly check the Terms and Conditions of Sale.
